Terms of Use

These Terms of Use ("Terms") are an agreement between you and Asha Singh ("we", "us", "our"), the developer of the Good Air app and widgets (the "App"). By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.

1. Licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial purposes. You may use it on devices that you own or control, as permitted by the rules of the app store you downloaded it from. The App is licensed to you, not sold.

2. What you may not do

You agree not to:

copy, modify, distribute, sell or rent the App or any part of it, or create derivative works of it;
reverse engineer, decompile or try to extract the App's source code, except where the law expressly allows it;
use our trademarks, name or logo without our written permission;
access, scrape, re-publish or commercially exploit data from the App or its data services, including our API, outside the normal use of the App;
interfere with, overload or try to gain unauthorised access to the App or the services it relies on;
use the App for any unlawful purpose.

3. Information only: not medical or safety advice

The App shows air quality, pollutant, weather, forecast and alert information for general information only. It is not a medical device. It does not provide medical, health, environmental or professional advice and must not replace advice from a qualified professional.

Accuracy: Readings come from monitoring stations, models and forecasts run by third parties. They can be delayed, incomplete, estimated or wrong. The nearest station may be several kilometres from you, and conditions can change quickly.
No guarantee of outcomes: Use the App as one input when making decisions. We don't guarantee your health or safety based on its readings.
Emergencies: For severe weather, wildfire smoke, pollution emergencies or other hazards, always follow instructions from official authorities and emergency services. Do not rely on the App.

4. Data sources and third-party services

The App uses publicly available data from official monitoring networks and open data services. These include the US EPA's AirNow network, India's CPCB network via OAQ India, and other national environmental agencies, as well as OpenAQ, Open-Meteo and OpenWeather. Weather is provided by Apple Weather together with official services such as the India Meteorological Department and the US National Weather Service. AQI values are calculated using published national methodologies.

Good Air is independent. It is not affiliated with, endorsed by or sponsored by any of these providers or by any government agency. Their data and services are subject to their own terms, and all trademarks belong to their respective owners. The App may link to third-party websites. We are not responsible for their content or practices.

5. Paid features and subscriptions

We may offer optional paid features or subscriptions in the future. If we do, the price, billing period and what's included will be shown in the App before you buy. Purchases are processed by Apple (App Store) or Google (Google Play) under their terms. We never receive your payment card details.

Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
You can manage or cancel a subscription at any time in your App Store or Google Play account settings. Cancellation takes effect at the end of the current period.
If a free trial is offered, any unused part of it ends when you buy a subscription.
Refunds are handled by Apple or Google under their refund policies.
If we change a subscription price, you will be told in advance as required by the app store, and you can cancel before the new price applies.

6. Requirements and availability

The App needs a compatible device and an internet connection. Some features, such as nearby air quality and the location widget, need permission to use your device's location. Without it, you can still search for and save cities.

We may change, suspend or discontinue any part of the App, or any data source, at any time. Data coverage varies by country and may change without notice. We may release updates, and some features may require the latest version.

7. Intellectual property and feedback

The App, including its design, code, text, graphics, icons and the Good Air name and logo, is owned by us or our licensors and is protected by intellectual property laws. We reserve all rights not expressly granted in these Terms. If you send us feedback or suggestions, we may use them freely without any obligation to you.

8. Disclaimer of warranties

To the maximum extent permitted by law, the App and all information in it are provided "as is" and "as available", without warranties of any kind, express or implied. This includes warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free or free of harmful components.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages. We are also not liable for any loss of health, life, data, profits or business arising from your use of, or inability to use, the App or any information in it, even if we were told such damage was possible. Our total liability for any claim relating to the App is limited to the amount you paid us for it in the 12 months before the claim, or USD 10 if you paid nothing. Some jurisdictions don't allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

10. Termination

You may stop using the App at any time by deleting it. Your licence ends automatically if you breach these Terms. Sections 3, 4 and 7–13 continue to apply after termination.

11. App Store terms (Apple devices)

If you downloaded the App from Apple's App Store, the following also applies:

These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
Your licence is limited to using the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App may also be used by other accounts associated with you through Family Sharing or volume purchasing.
We are solely responsible for providing maintenance and support for the App. Apple has no obligation to do so.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for it. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility.
We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your use of it. These include product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
If a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging the claim.
You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
You must comply with any applicable third-party terms, such as your wireless data service agreement, when using the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple may enforce these Terms against you as a third-party beneficiary.

Where these Terms don't cover something, Apple's Licensed Application End User License Agreement applies.

12. Google Play terms (Android devices)

If you download the App from Google Play, your use of Google Play, and any purchases made through it, are also governed by the Google Play Terms of Service. Google is not responsible for the App or its content.

13. Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-law rules. If you are a consumer, you keep the protection of any mandatory laws of the country where you live, and you may bring claims in your local courts where the law allows.

14. Changes to these Terms

We may update these Terms from time to time. We'll post the new version on this page and update the date at the top. If the changes are significant, we'll also tell you in the App. If you keep using the App after the changes take effect, you accept the updated Terms.
